FMLA - Family Medical Leave Act

Family Medical Leave Act (FMLA) 

FMLA requires covered employers to provide up to 12 weeks of unpaid, job-protected leave to "eligible" employees for certain family and medical reasons, during a defined 12-month leave year. The districts applicable "leave year" is a "rolling" twelve-month period, measured backward from the date an employee uses any FMLA leave. Employees are eligible if they have worked for KPS for at least one year and for 1,250 hours over the previous 12 months.

Basic Leave Entitlement
FMLA provides up to 12 weeks of unpaid, job-protected leave to eligible employees for the following reasons:

  1. The birth of a child or placement of a child for adoption or foster care;
  2. To bond with a child (leave must be taken within 1 year of the child's birth or placement);
  3. To care for the employee's spouse, child, or parent who has a qualifying serious health condition;
  4. For the employee's own qualifying serious health condition that makes the employee unable to perform the employee's job;
  5. For qualifying exigencies related to the foreign deployment of a military member who is the employee's spouse, child, or parent.
